Terms & Conditions (TRYMYWEBSITES™)
Welcome to TRYMYWEBSITES™.
By accessing our website, requesting a quotation, making any payment,
approving a proposal, or engaging our services, the Client acknowledges
that they have read, understood, and agreed to these Terms & Conditions.
1. Scope of Services
-
TRYMYWEBSITES™ provides web design, web development, application development,
digital marketing, SEO, branding, graphic design, maintenance and other
technology-related services as specified in the approved quotation, proposal,
invoice, work order, or written agreement.
-
Only the services specifically mentioned in the approved scope are included
in the project.
-
Any additional features, pages, integrations, redesigns, content work,
functionality, or modifications requested by the Client may be treated as
additional work and charged separately.

TRYMYWEBSITES™ reserves the right to decline any request that is technically
impractical, unlawful, outside the agreed scope, or inconsistent with the
original project requirements.
2. Quotations, Pricing & Payments
-
Quotations are valid for the period stated in the quotation or, where no
period is specified, for 30 days from the date of issue.
-
Project work will normally commence only after receipt of the required
advance payment and necessary project materials.
-
Unless otherwise agreed in writing, an advance payment of at least 50%
may be required before commencement of work.
-
The remaining payment must be completed according to the agreed payment
milestones and, in all cases, before final handover, deployment, transfer
of source files, credentials, or ownership.
-
TRYMYWEBSITES™ may suspend development, support, hosting management,
deployment, or other services where payments are overdue.
-
Any applicable taxes, third-party fees, payment gateway charges, domain
charges, hosting charges, software licences, API charges, or similar costs
may be charged separately unless expressly included in the quotation.
3. No Refund, Cancellation & Project Termination Policy
-
All payments made to TRYMYWEBSITES™, including
advance payments, milestone payments, partial payments, and final payments,
are non-refundable once received, subject to applicable law.
-
No refund will be provided if the Client cancels, withdraws, abandons, postpones,
or decides not to continue the project after making payment or after the project
has commenced.
-
TRYMYWEBSITES™ reserves the right to cancel, suspend, discontinue, or terminate
a project where reasonably necessary, including due to non-payment, Client
non-cooperation, prolonged delays, failure to provide required materials or
approvals, breach of agreed terms, abusive conduct, unlawful requirements,
security concerns, or other material circumstances affecting the project.

Where TRYMYWEBSITES™ cancels, suspends, or terminates a project for reasons
attributable to the Client, amounts already paid will not be refunded, subject
to applicable law.

Where TRYMYWEBSITES™ is unable to continue a project for reasons not attributable
to the Client, any refund or settlement, if legally required, will be determined
based on applicable law and the work, costs, resources, and third-party expenses
already incurred.

No refund will be provided where project delays are caused by the Client,
including failure to provide content, information, approvals, credentials,
feedback, payments, or other materials required for the project.

Payments relating to work already commenced or performed, including web design,
web development, application development, digital marketing, SEO, graphic design,
maintenance, consultation, or other agreed services, are non-refundable.

Payments or expenses relating to third-party services, including domains, hosting,
SSL certificates, software licences, premium plugins, APIs, advertisements,
subscriptions, payment gateways, or other external services, are non-refundable
once purchased, activated, committed, or paid to the relevant provider.

Cancellation, suspension, or termination of a project does not remove the
Client's obligation to pay any outstanding amount properly due for completed
work, approved milestones, allocated resources, or third-party expenses.

By making a payment, approving a quotation or proposal, or instructing
TRYMYWEBSITES™ to commence work, the Client acknowledges and accepts this
No Refund, Cancellation & Project Termination Policy.
4. Client Responsibilities
-
The Client must provide accurate project requirements, content, images,
logos, product information, credentials, approvals, and other required
materials within a reasonable time.
-
The Client is responsible for reviewing and verifying all information
supplied for publication.
-
The Client confirms that they have the necessary rights, permissions,
licences, or authorization to use all content and materials supplied to
TRYMYWEBSITES™.
-
TRYMYWEBSITES™ will not be responsible for copyright, trademark, privacy,
licensing, or other claims arising from materials supplied or specifically
requested by the Client.
-
Delays in providing content, approvals, payments, credentials, or feedback
may result in corresponding changes to the project schedule.
5. Client Delays & Inactive Projects
-
Project timelines depend upon timely communication, feedback, approvals,
payments, and materials from the Client.
-
TRYMYWEBSITES™ will not be responsible for delays resulting from the
Client's failure to provide required information, approvals, access, or
payments.
-
Projects that remain inactive because of Client-side delays for an extended
period may be placed on hold and rescheduled according to resource
availability.
-
Additional charges may apply where substantial rework, resource
reallocation, or project restart is required due to prolonged Client delays.
6. Revisions & Change Requests
-
Revisions included in the project are limited to those reasonably falling
within the originally approved scope.
-
Requests that materially alter an approved design, functionality, workflow,
database structure, integration, or project scope may be quoted separately.
-
Repeated revisions or requests to redo previously approved work may attract
additional charges.
7. Project Timeline & Delivery
-
Any delivery date or development timeline provided is an estimate unless
expressly guaranteed in a written agreement.
-
Timelines may change due to additional requirements, Client delays,
technical complications, third-party services, external approvals, or
circumstances outside our reasonable control.
-
TRYMYWEBSITES™ will make reasonable efforts to complete projects within
the estimated timeline but does not guarantee completion by a particular
date unless specifically agreed in writing.
8. Project Review & Acceptance
-
The Client is responsible for reviewing the website, application, design,
or other deliverables before final approval or launch.
-
Any errors, missing information, or required corrections should be reported
during the agreed review period.
-
Unless otherwise agreed, if the Client does not provide material feedback
within 7 days after delivery or review notification, the relevant
deliverable may be considered accepted.
-
New requirements requested after final approval may be treated as additional
work and charged separately.
9. Website Launch & Post-Delivery Support
-
TRYMYWEBSITES™ will correct reproducible defects attributable to our work
that are reported within any support or warranty period specifically
included in the project agreement.
-
Unless expressly included, ongoing website maintenance, content updates,
security monitoring, backups, server management, technical support, and
future modifications are separate services.
-
Issues caused by Client modifications, third-party developers, plugin or
software updates, hosting changes, malware, compromised credentials,
external APIs, or unsupported modifications are not considered development
defects attributable to TRYMYWEBSITES™.
10. Domain & Hosting Services
-
Domain registration, hosting, SSL certificates, business email, server
management, and related services are separate unless specifically included
in the project quotation.
-
Where TRYMYWEBSITES™ assists with third-party hosting or domain services,
those services remain subject to the respective provider's terms,
availability, policies, and technical limitations.
-
TRYMYWEBSITES™ is not responsible for outages, server failures, email
failures, domain suspension, provider-side data loss, DNS issues, or other
disruptions caused by third-party service providers.
-
The Client is responsible for timely renewal of domains, hosting, SSL,
email services, licences, and subscriptions unless a separate management
arrangement has been agreed.
11. Third-Party Services
-
Projects may use third-party services such as hosting providers, payment
gateways, APIs, plugins, libraries, analytics tools, social media platforms,
maps, email providers, advertising platforms, or external software.
-
TRYMYWEBSITES™ does not control and cannot guarantee the continuous
availability, pricing, functionality, policies, compatibility, or security
of third-party services.
-
Changes made by third-party providers after project completion may require
additional development or maintenance work, which may be charged separately.
12. Backups & Data
-
Unless backup management is specifically included as a paid service,
the Client is responsible for maintaining appropriate backups of their
website, database, email, files, and other important data after handover.
-
TRYMYWEBSITES™ does not guarantee recovery of data lost due to hosting
failures, Client actions, third-party services, malware, cyber incidents,
hardware failures, or circumstances outside our reasonable control.
13. Website Security
-
TRYMYWEBSITES™ will use reasonable development practices appropriate to
the agreed project scope; however, no website, application, server, or
online system can be guaranteed to be completely secure.
-
TRYMYWEBSITES™ does not guarantee that a website will never experience
hacking attempts, malware, vulnerabilities, spam, unauthorized access,
or other cybersecurity incidents.
-
The Client is responsible for protecting passwords, administrative
credentials, hosting credentials, and other account access after handover.
14. SEO & Digital Marketing
-
SEO, digital marketing, social media marketing, advertising, and similar
services are influenced by search engines, advertising platforms,
competitors, algorithms, market conditions, customer behaviour, and other
factors outside the control of TRYMYWEBSITES™.
-
Unless expressly guaranteed in a separate written agreement,
TRYMYWEBSITES™ does not guarantee specific Google rankings, traffic levels,
enquiries, leads, sales, revenue, followers, conversions, or other business
results.
-
Search engines and social media platforms may change their algorithms,
policies, or account rules without notice.
15. E-Commerce & Payment Gateways
-
Where e-commerce functionality is provided, TRYMYWEBSITES™ is responsible
only for the development and integration work included in the agreed scope.
-
Payment processing, settlements, transaction failures, chargebacks,
gateway approvals, banking issues, refunds, and account restrictions are
subject to the Client's payment gateway or financial service provider.
-
The Client is responsible for their products, pricing, taxation, shipping,
refund policies, customer service, legal compliance, and business
transactions conducted through their website.
16. Intellectual Property & Ownership
-
Until all outstanding payments relating to the project are received,
TRYMYWEBSITES™ retains rights in the custom deliverables created by it,
subject to applicable law and any separate written agreement.
-
Upon full payment, ownership or usage rights in the final custom deliverables
will transfer to the Client to the extent specified in the applicable
agreement.
-
Third-party software, fonts, plugins, stock assets, libraries, themes,
frameworks, APIs, and licensed materials remain subject to their respective
licences and are not transferred as TRYMYWEBSITES™ intellectual property.
-
Unless confidentiality obligations or a written agreement provide otherwise,
TRYMYWEBSITES™ may identify completed work in its portfolio and marketing
materials using publicly available screenshots, project descriptions,
and Client business names or logos.
17. Confidentiality
Both parties agree to take reasonable steps to protect confidential business,
technical, financial, login, and project information received from the other
party and not disclose such information except where required to perform the
services, with authorization, or as required by law.
18. Legal Compliance

The Client is responsible for ensuring that their business, website content,
products, services, advertisements, privacy notices, terms, and business
practices comply with laws and regulations applicable to their operations.

TRYMYWEBSITES™ does not provide legal, tax, accounting, or regulatory advice
unless expressly agreed and appropriately qualified to do so.
19. Limitation of Liability
-
To the maximum extent permitted by applicable law, TRYMYWEBSITES™ will not
be liable for indirect, incidental, special, consequential, or business
losses arising from the use or inability to use the delivered services,
including loss of profits, revenue, business opportunities, goodwill, or
data.

TRYMYWEBSITES™ will not be responsible for losses caused by third-party
providers, Client actions, unauthorized modifications, compromised
credentials, external attacks, platform changes, or events outside our
reasonable control.

To the maximum extent permitted by applicable law, TRYMYWEBSITES™'s total
aggregate liability relating to a particular project will not exceed the
amount actually paid to TRYMYWEBSITES™ for the specific services giving
rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally
be excluded or limited under applicable law.
20. Indemnification
To the extent permitted by applicable law, the Client agrees to be responsible
for third-party claims, losses, or expenses arising from unlawful or infringing
materials supplied by the Client, misuse of the delivered services, or the
Client's violation of applicable law or third-party rights.
21. Suspension & Termination
-
TRYMYWEBSITES™ may suspend work or services where payments are overdue,
required information is not provided, the Client materially breaches the
agreement, or continued work would involve unlawful or abusive activity.
-
Either party may terminate a project in accordance with the applicable
proposal, quotation, or written agreement.
-
On termination, the Client remains responsible for payment for work already
completed, committed resources, third-party expenses, and other amounts
properly due up to the termination date.
-
Final files, source code, credentials, or project ownership need not be
transferred until all amounts properly due have been paid.
22. Force Majeure
TRYMYWEBSITES™ will not be responsible for delays or failure to perform caused
by circumstances beyond its reasonable control, including natural disasters,
internet or power failures, government actions, strikes, widespread cyber
incidents, third-party platform outages, war, civil disturbances, epidemics,
or other comparable events.
23. Communication & Approvals
Instructions, approvals, confirmations, and change requests communicated through
agreed business channels, including email or other mutually accepted electronic
communication methods, may be relied upon for project execution.
24. Governing Law & Disputes
These Terms & Conditions shall be governed by the laws of India. Subject to any
mandatory legal requirements, disputes relating to the services shall be subject
to the jurisdiction specified in the applicable contract or, where no jurisdiction
is specified, the competent courts having jurisdiction over TRYMYWEBSITES™'s
principal place of business.
25. Changes to Terms
TRYMYWEBSITES™ may update these Terms & Conditions from time to time.
Updated Terms will apply prospectively from their effective date, except where
changes are required by law or separately agreed with an existing Client.
26. Acceptance of Terms
By approving a quotation or proposal, making a payment, instructing
TRYMYWEBSITES™ to commence work, or continuing to use our services after being
provided with these Terms, the Client confirms acceptance of these Terms &
Conditions, subject to applicable law.
